Terms of Use

These terms cover the KidSwing app and the kidswing.app website. KidSwing is made by Arai Holdings LLC, a Michigan limited liability company doing business as Built by a Dad ("we," "us"). By using KidSwing you agree to what's on this page.

We've tried to write this in plain English. Where something matters, we've said it plainly rather than burying it.

Your license to use the app

KidSwing is distributed through Apple's App Store, and your license to use it is governed by Apple's standard Licensed Application End User License Agreement, which you can read at apple.com/legal/internet-services/itunes/dev/stdeula. We haven't written our own replacement for it. This page adds the things that agreement doesn't cover: what KidSwing is for, what it isn't, and what we do and don't promise.

What KidSwing is

KidSwing is a coaching and measurement tool for youth baseball and softball. It uses your device's camera to measure how a player's body moves during a swing, compares those measurements against a reference model of sound mechanics, and turns the result into feedback a parent or coach can act on.

What KidSwing is not

It is not a medical or diagnostic device. KidSwing does not diagnose, treat, prevent, rehabilitate, or screen for any injury, condition, or impairment, and we make no medical claims of any kind.

Its measurements and comparisons — including form grades, sequence feedback, and any comparison to a reference or to a player's own history — are provided as athletic development context only. They are not a clinical assessment of anything.

Using KidSwing for injury screening, physical therapy tracking, return-to-play decisions, or any other health purpose is outside what this product is built or tested for, and we don't support it. Those decisions belong to qualified medical professionals. If a player is in pain, stop and see a doctor. Nothing in this app is a reason to keep swinging.

We do not guarantee results. KidSwing does not promise that any player will improve, hit better, swing faster, make a team, or achieve any particular outcome. It measures what happened. What a player does with that is up to them, their coaches, and their practice.

What the measurements mean, and what they don't

This section exists because we'd rather explain a limitation than have you discover it.

A form grade is a comparison, not a verdict. When KidSwing flags something in a swing, it is reporting that a measured value fell outside a reference range. It is not a judgment about whether a player is good, and it is not a prediction about anything.

Measurements come from a camera, and cameras have limits. How much the app can see depends on the angle, the light, the clothing, and where the player is in frame. Some things a coach can see with their own eyes cannot be measured from a single camera position at all. Where that's the case, KidSwing is built to show nothing rather than to estimate and present the estimate as a measurement. A blank value means "not measured," not "zero."

Precision is not implied by a decimal point. A number shown to one decimal place is not therefore accurate to one decimal place. Treat the app's output as a consistent way to track change over time, which is what it's genuinely good at, rather than as a certified value.

KidSwing is not a substitute for a coach. It measures things a coach can use. It doesn't know your player, their season, their confidence, or what they worked on last week.

If you use KidSwing as a coach

Coaching accounts measure children who are not your own. By using KidSwing as a coach or organization, you confirm that you have the right to collect practice data for the players in your program, and that those players' families have been informed that you are doing so.

That's your responsibility, not ours. We have no relationship with the families of the players you coach and no way to reach them. You are the one who owes them that conversation.

KidSwing does not create video, which means coaching a team with it does not produce footage of other families' children. Please don't defeat that by capturing your screen. If you do, whatever you create is yours and it is entirely your responsibility.

Trying KidSwing before you buy

KidSwing includes a free trial so you can measure a real player before paying for anything. The trial covers a set number of live practice swings and one Structured Analysis session, counted separately, and the current amounts are shown in the app. The trial is tracked on the device, so it does not reset by deleting and reinstalling the app.

Purchases and licenses

Licenses are sold through Apple's App Store. Apple handles all payment processing; we never receive your payment information.

SeasonPass, when it launches, will involve storing a copy of your practice data on a server — that is what backup, scheduled reports, and comparison against other players require. It is a separate opt-in for that reason. These terms and the Privacy Policy will be updated to describe it before the feature is available, and nothing already on your device begins leaving it because the feature exists.

Current prices are shown in the app and may change. A change in price never affects a one-time purchase you already own.

A license is tied to the Apple ID that purchased it and is not transferable between accounts. Player limits are counted per device.

Refunds are handled by Apple, not by us, under Apple's refund policy at reportaproblem.apple.com. We have no ability to issue, approve, or deny a refund. If an annual Coach purchase is refunded, the permanent Parent license that came with it ends as well — a refund undoes the purchase rather than keeping part of it.

If a subscription lapses: you keep access to the data already on your device, and you can still read it and export it. Starting new capture sessions requires an active license. We will not lock a player's own history behind a renewal.

Acceptable use

Don't use KidSwing to measure someone who hasn't agreed to be measured. Don't use it to identify, track, or evaluate a person outside of coaching the sport it's built for. Don't attempt to bypass license limits, reverse-engineer the app, or resell access to it.

Your data and your content

Your player profiles, sessions, and measurements are yours. They live on your device and we never receive them — see the Privacy Policy for the full description. We claim no license or ownership over anything you create with KidSwing, and we never acquire rights to any image, likeness, or recording of any player, because the app doesn't create any.

If you use an Apple Watch with KidSwing, its motion measurements travel to the iPhone that watch is paired to and stay there. Nothing is written into your Health data and nothing is sent to us. An Apple Watch pairs with an iPhone and not with an iPad; that is Apple's design, not ours.

Exporting your data is not a paid feature, and it will not become one. Whatever tier you are on, including none, you can take your measurements out of the app.

We are not responsible for the loss of data on your device. Because nothing is stored on a server, a lost or damaged device means lost history, and we cannot recover it. Your device's own backup is what protects it.

Our content

The KidSwing name, logo, wordmark, app design, and the text on this site belong to us. Don't use them as your own.

Typography

KidSwing is set in Gagalin, designed by Iordanis Passas and released by Fontfabric, used under Fontfabric's Free Font End User License Agreement. We're grateful for it — a small product gets to look like itself because a foundry chose to give something away.

Availability, and changes

KidSwing is currently available in the United States. We may add or remove features, and we may stop offering the app. If we make a change that meaningfully reduces what a paid license gives you, we'll say so in the app rather than quietly.

We may update these terms. If we do, we'll change the date at the top, and we'll tell you in the app if the change is significant.

Disclaimer of warranties

KidSwing is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any measurement will be accurate for any particular purpose.

Some states don't allow the exclusion of certain warranties, so parts of this may not apply to you.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, arising from your use of KidSwing. Our total liability for any claim relating to KidSwing will not exceed the amount you paid for it.

Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules.
